SMS Messaging Terms and Compliance

Program Description

The Epoxy Panda SMS program sends messages to customers and prospective customers who have contacted us, scheduled an appointment or consultation, requested information, purchased a service, or otherwise expressly opted in to receive text messages.

Messages may include appointment confirmations and reminders, scheduling updates, service notifications, account updates, customer-support communications, and promotional messages when the recipient has provided the appropriate consent.

SMS consent may be collected through our website, scheduling forms, intake forms, or other authorized opt-in methods. When collected through a web form, SMS consent is obtained using a dedicated consent checkbox or similar affirmative action.

Consent to receive SMS messages is not a condition of purchasing any product or service.

Cancellation Instructions

You may cancel SMS messages at any time by replying STOP to the number that sent you the message. After replying STOP, you will receive a final confirmation that you have been unsubscribed. You will not receive additional SMS messages unless you subsequently opt in again.

Carrier Liability

Wireless carriers are not responsible for delayed or undelivered messages.

Message and data rates may apply to messages sent to or received from Epoxy Panda. Message frequency varies based on your interactions, services, account activity, and communication preferences. Contact your wireless carrier if you have questions about your text-messaging or data plan.

Supported Carriers

Our SMS program is intended to work with major U.S. wireless carriers and many regional carriers. Message delivery is subject to carrier availability and network conditions.

Age Restriction

You must be at least 18 years old or have the permission of a parent or legal guardian to participate in our SMS program.

General Terms

This website, including its pages, content, features, forms, and services, is referred to collectively as the “Site.” The Site is owned and operated by Epoxy Panda (“Epoxy Panda,” “Company,” “we,” “our,” or “us”).

By accessing or using the Site, you agree to be bound by these Terms of Service, our Privacy Policy, and any additional terms that may apply to specific services or sections of the Site. If you do not agree to these Terms, you should not access or use the Site or our services.

We reserve the right to update these Terms. Updated Terms will be posted on our website with a revised effective date. Your continued use of the Site after changes are posted constitutes your acceptance of the updated Terms.

Services

Epoxy Panda provides residential and commercial concrete coating services, including garage floors, patios and outdoor concrete, shops, warehouses, and commercial spaces. Prices, ranges, and estimates shown on the Site, including our planning calculator, are based on the information you provide and are planning figures only, not a binding quote. The scope and final price of a project are confirmed after an in-person consultation and may be adjusted if conditions at the property differ from what was described. Our team will discuss any change with you before work begins.

Results depend on factors such as the age, condition, moisture, and surface preparation of the concrete. Some cracks, stains, damage, or wear may not be fully correctable, and our team will point these out when possible.

Customers are responsible for providing accurate information about the service requested and reasonable access to the areas being coated.

Payments

Prices and payment terms will be disclosed at the time of booking or in the applicable quote or invoice. By providing a payment method, you authorize Epoxy Panda and its payment processors to charge the applicable fees. Unless otherwise stated in writing, fees are charged in U.S. dollars and customers are responsible for applicable taxes.

Intellectual Property Rights

The Site and the materials made available through it—including text, graphics, logos, branding, photos, and videos—are owned by or licensed to Epoxy Panda and are protected by copyright, trademark, and other intellectual-property laws. Epoxy Panda grants you a limited, revocable, non-exclusive, and non-transferable license to access and use the Site for lawful personal purposes.

Unless Epoxy Panda provides written authorization, you may not:

• Copy, reproduce, republish, or redistribute Site materials
• Modify, translate, or create derivative works from Site materials
• Sell, sublicense, license, or commercially exploit Site materials

• Use our names, trademarks, or branding without permission

Your License to Us

Governing Law and Dispute Resolution

Before beginning formal legal proceedings, you agree to contact Epoxy Panda and make a good-faith effort to resolve the dispute informally. Any dispute that cannot be resolved informally will be resolved through binding individual arbitration in Texas, except when applicable law permits a party to bring an eligible claim in small-claims court or seek emergency injunctive relief. Claims must be brought individually and not as part of a class, consolidated, or representative action, to the extent permitted by law.

Severability and Entire Agreement

If any portion of these Terms is determined to be unlawful, invalid, or unenforceable, that provision will be enforced to the maximum extent permitted by law, and the remaining provisions will continue in full force and effect. These Terms, our Privacy Policy, and any applicable quote or invoice constitute the entire agreement concerning your use of the Site and the applicable services.
